Terms of Service

Effective Date: June 8, 2026  ·  Governing Law: State of South Carolina

Please read these Terms of Service carefully before booking. By submitting a booking fee, signing a service agreement, or engaging Golden Celebrations LLC for any service, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. These Terms apply to all services offered by Golden Celebrations LLC, including, but not limited to, Luxury Wedding Films, White Glove Wedding & Event Planning, Event Videography, and Destination Wedding services.

Definitions

"GC" refers to Golden Celebrations LLC, its employees, contractors, sub-contractors, officers, and agents.

"The Client" refers to the couple being served, as well as any person(s) paying for all or a portion of the products or services contracted.

"Booking Fee" refers to the non-refundable retainer paid at the time of booking to secure the event date on GC's calendar.

"Event" refers to the specific occasion, ceremony, or milestone for which GC has been contracted to provide services.


01 — Booking Fee, Payment & Payment Plans

Booking Fee

The Client shall pay a non-refundable Booking Fee in the amount specified in the individual service agreement to secure the services and products outlined therein. The Booking Fee is earned by GC upon receipt. No event date is held without a paid Booking Fee. All payments received shall first be applied to any outstanding Booking Fee balance.

Final Balance

The remaining balance must be paid in full no later than ten (10) days prior to the Event date. GC will not release any video or product for viewing until all account balances have been paid in full. GC reserves the right to enforce the terms of this agreement to obtain payment. Sales tax will be added to all invoice amounts.

Payment Plans

If The Client elects to enter into a payment plan, the Booking Fee shall be paid at the time of booking to secure the date and shall serve as the first payment toward the total balance. The remaining balance shall be divided into equal monthly increments, payable each month leading up to the month of the Event date, until the balance is paid in full.

If GC does not receive payment in full ten (10) days before the Event date, GC reserves the right to cancel services for the scheduled date. In the event of such cancellation, GC will not attend the Event on the scheduled date and no refunds will be given.

Late Fees

A five percent (5%) late fee shall be applied to any payment that is not received by the scheduled due date. An additional five percent (5%) will be added to any remaining balance for each calendar month it remains unpaid.

Last-Minute Bookings

If the Event date is within three (3) months of the booking date, no payment plan shall be available. The Client shall pay the full Booking Fee at the time of booking to secure the date, and the remaining balance must be paid in full ten (10) days prior to the Event.


02 — Cancellation & Postponement

Cancellation by Client

The Booking Fee is non-refundable under all circumstances. In the event The Client cancels the contracted services, the following refund schedule shall apply to any fees paid beyond the Booking Fee:

Less than 90 days before the Event: All fees paid (excluding the Booking Fee) are forfeited and non-refundable.

Between 90 and 180 days before the Event: The Client is entitled to a refund of fifty percent (50%) of all fees paid, excluding the Booking Fee.

More than 180 days before the Event: The Client is entitled to a refund of all fees paid, excluding the Booking Fee, which remains non-refundable.

All cancellation notices must be submitted in writing to GC. Verbal or implied cancellations will not be accepted.

Postponement & Date Changes

If The Client wishes to postpone or otherwise change the Event date, The Client must first submit a written release to GC referencing the original contracted date. This written release will void the existing contract.

If GC is available for the desired new date, GC and The Client will execute a new service agreement, and all monies previously paid will transfer in full to the new date. The new date must be scheduled within twelve (12) months of the original contracted date. If the new date falls outside this twelve-month window, the new agreement will be subject to GC's then-current service rates. GC cannot guarantee availability for any requested new date.


03 — Copyright & Reproductions

Ownership

GC owns the copyright for all video and media created at the Event and holds the exclusive right to make reproductions. GC will make reproductions for The Client or for GC's portfolio, company samples, self-promotion, entry in cinematography contests or exhibitions, instructional purposes, editorial use, advertising, and any other business needs GC deems appropriate. Any such use will be exercised with the highest standards of taste and judgment.

If GC desires to use Event video for purposes beyond those specified above, GC shall obtain prior written permission from The Client. The Client understands they are not entitled to any compensation or other consideration for GC's use of Event video for the purposes outlined herein.

It is a violation of federal copyright law to allow video created by GC to be duplicated, digitally reproduced, copied, or altered without the written permission of GC. The Client agrees not to copy or reproduce video in any manner, for any reason, without a written release from GC.

Client Usage License

The Client is obtaining videos for personal use only and shall not sell or authorize any reproductions by parties other than GC. By releasing the final videos to The Client, GC authorizes The Client to use the videos received for their own personal use, including sharing on personal social media platforms. Requests for additional or replacement copies of files may be purchased and are subject to GC's then-current rates. Files will be delivered via online digital download.


04 — Failure to Perform

If GC, its employees, contractors, officers, or other assigns cannot perform the services outlined in any service agreement due to fire, casualty, act of God, illness, or any other cause beyond GC's control, GC will return all monies paid to The Client, excluding the Booking Fee, and will have no further liability with respect to that agreement.

This limitation of liability shall also apply in the event that video materials are damaged in processing, lost through camera or memory card malfunction, lost in transit, or otherwise lost or damaged without fault on the part of GC.

The Client and GC both assume the risks and dangers inherent in GC's travel to and from the Event. In the extremely unlikely event that a last-minute act of nature or travel-related disaster occurs while GC is en route to the Event, GC will refund The Client all monies paid, excluding the Booking Fee.

In the event that GC fails to perform for any other reason, GC shall not be liable for any amount in excess of the total value of The Client's contracted package.

Cinematographer Substitution

In the extremely unlikely event of severe personal illness or other circumstances beyond GC's control that preclude GC's principals from personally performing their duties, GC will make a good-faith effort to retain a substitute cinematographer of high qualification, subject to The Client's approval of said cinematographer.

Storage Media & Equipment

While GC adheres to the highest standards in filming materials and equipment, The Client releases GC from any liability for claims arising from the failure of hard drives, flash media, USB drives, or any other storage media used in connection with the Event.


05 — Artistic Rights & Editorial Control

Creative Discretion

GC retains the right of discretion in selecting the content released to The Client. GC also retains the right to make all adjustments to video in post-production as the cinematographer deems appropriate within their creative control. The recording of the Event, post-production editing, and the length of the final product are at the sole discretion of GC.

If The Client does not wish for a specific moment to appear in the final video, The Client must inform GC of this preference before editing begins. GC is the exclusive official videographer retained by The Client to cover the Event, and is granted full production and editorial control by The Client regarding all aspects of production and post-production services for the Event.

Quality Limitations

GC is not responsible for poor audio quality if The Client does not agree to wear a lapel microphone. GC is not responsible for dark or grainy video resulting from inadequate venue lighting, refusal by The Client or the venue to allow supplemental video lighting at the reception, or electrical or mechanical malfunctions on location that are beyond the control of GC.

Editing Revisions

The Client will receive up to one (1) hour of complimentary editing changes following delivery of the final product. Thereafter, additional changes will be billed at GC's current editing rate. GC will provide The Client with an estimated time to complete any requested changes and will not perform any billable revision work without written approval from The Client.

Editing errors made by GC (e.g., spelling or technical errors) will be corrected at no charge. Edit requests from The Client must be submitted no later than fourteen (14) days after the date The Client receives the product. GC is under no obligation to honor editing requests submitted after this fourteen-day period has expired.


06 — Deliverables & Completion Schedule

Delivery Timelines

Completion schedules and delivery of products are determined from the date of the Event, provided all pre-production materials have been received by GC. Standard estimated delivery timelines are as follows:

  • Bronze & Silver packages: Approximately 8–12 weeks after the Event date
  • Golden package: Approximately 5–10 weeks after the Event date
  • Diamond package (all deliverables excluding The Heirloom Documentary Film): Approximately 5–10 weeks after the Event date
  • Diamond package (The Heirloom Documentary Film): Approximately 12–16 weeks after the final recorded milestone
  • Event Videography & Destination Wedding: As specified in the individual service agreement

Completion times are estimates only. Any period of additional time required for completion will not void any individual service agreement. The Client should account for normal production delays when planning around delivery. GC shall not be held responsible for delivery delays caused by third-party manufacturing or delivery services.

Expedited Delivery

If The Client requires delivery in less than the standard timeline, an expedited fee equal to fifty percent (50%) of the original product price shall be applied. The Client must notify GC at the time of the order if expedited delivery is required.

Delivery Format

Final deliverables will be provided via online digital delivery. GC is not responsible for maintaining access to delivered files indefinitely. The Client is responsible for downloading and archiving all materials upon receipt.


07 — Officiant & Venue Restrictions

GC may be necessarily limited by the guidelines, rules, or restrictions imposed by the ceremony officiant, ceremony venue, or reception venue. The Client understands and agrees that GC will abide by all such guidelines and rules, which are outside GC's control. The Client agrees to hold GC harmless for any impact such guidelines or restrictions may have on the resulting video coverage.

To the extent possible, The Client agrees to inform GC of any known venue or officiant restrictions at least thirty (30) days in advance of the Event date. GC cannot be held responsible for restrictions not disclosed in advance.


08 — Requested Footage

While GC will make every reasonable effort to capture specifically requested video, The Client understands that weddings and live events are uncontrolled environments. Due to variables including but not limited to weather, available light, venue restrictions, and the willingness or availability of subjects, GC cannot guarantee that any particular requested video clip will be captured.

GC will not be held responsible for the lack of coverage caused by: The Client, wedding party, or family members not being present or on time; members of the wedding party or family being unavailable when called upon for a specific shot; the Event running behind schedule; or venue-imposed filming restrictions.


09 — Cooperation & Safe Working Environment

Client and Guest Cooperation

The Client will cooperate with GC and defer to GC's professional judgment regarding setting, positioning, grouping, and other matters of artistic discretion. GC retains the right to decline to capture any situation, pose, or grouping that would interfere with GC's artistic judgment. The Client agrees to use their best efforts to ensure that guests and attendees cooperate with GC's cinematography team throughout the Event.

Safe Working Environment

The Client agrees to use their best efforts to ensure that all guests and attendees treat GC's staff with respect and dignity and that GC is provided with a safe working environment throughout the Event. GC retains the right to cancel the remainder of any video session if guests or attendees of the Event commit acts of sexual harassment, violence, threats, or any other conduct that would cause a reasonable person to feel unsafe. In the event of such cancellation, The Client shall not be entitled to any refund.


10 — Standard Price List & Future Additions

Pricing

All investments outlined in any GC service agreement are based on GC's standard price list at the time of booking. This price list is subject to reasonable adjustments periodically. Any future orders or additions to an existing agreement shall be charged at the prices in effect at the time the order is placed or the change is requested.

Additions to Services

The Client has the option to add products or services to any existing agreement. Additions to the list of deliverables may be made at any time and will be charged at GC's current rates at the time of the addition request.

Raw Footage

GC retains ownership of all raw, unedited footage captured during any service engagement. Raw footage is not included in any standard package and is not provided to clients by default. Raw footage may be purchased as a paid add-on at GC's then-current rates, subject to availability.


11 — Insurance

GC maintains business liability insurance to protect against claims by property owners for accidental damage caused by GC and GC's staff during the course of services. Certification of insurance is available upon written request.

If a venue requires GC to be listed as an additional insured entity on GC's insurance policy, this request must be submitted to GC no less than thirty (30) days prior to the Event date. Any additional fees incurred by GC from its insurance provider as a result of this request will be charged to The Client. The Client may then seek reimbursement from the venue directly. GC shall not be liable if the venue declines to reimburse The Client for such fees.


12 — Parking & Travel Fees

Parking

The Client is responsible for any parking fees incurred by GC and GC's team during the course of services. GC will document any such fees and include them on a final invoice to The Client.

Destination & Travel Services

For Destination Wedding services, travel fees applicable to engagements outside GC's local service area will be quoted individually and communicated to The Client before any binding agreement is finalized. Meagan, a licensed travel advisor and active member of the American Society of Travel Advisors (ASTA), coordinates all travel logistics for GC's team. The Client agrees to cooperate with travel planning requests in a timely manner. Delays in providing required information may affect GC's ability to fulfill services and will not entitle The Client to any refund or fee reduction.


13 — Indemnification

GC shall be held harmless for any and all injury to The Client and The Client's property during the course of the Event and any immediately surrounding activities for which GC has been contracted.


14 — White Glove Planning & Third-Party Vendors

For White Glove Wedding & Event Planning services, GC may recommend, source, and facilitate contracts with third-party vendors including but not limited to florists, caterers, venues, photographers, videographers, entertainers, rental companies, and transportation providers on The Client's behalf.

While GC exercises professional judgment in vendor selection and coordination, GC is not a party to, and is not responsible or liable for, the performance, quality, reliability, or actions of any third-party vendor. All third-party vendor agreements are independent contracts between The Client and the respective vendor. Any disputes arising from third-party vendor performance must be resolved directly between The Client and the vendor. GC will, at its discretion, provide good-faith assistance in mediating such disputes as a courtesy, which does not constitute legal liability on GC's part.


15 — Attorney's Fees

Should any litigation be commenced between the parties to this agreement concerning any provision of these Terms or the rights and obligations of either party, the prevailing party in such litigation shall be entitled to a reasonable sum for attorney's fees, as determined by the Court in such litigation or in a separate action brought for that purpose.


16 — Assignment

The Client agrees that they will not assign, sell, transfer, delegate, or otherwise dispose of, whether voluntarily or involuntarily or by operation of law, any rights or obligations under any agreement with GC. Any such purported assignment, transfer, or delegation by The Client shall be null and void.

GC reserves the right to assign, sell, transfer, or delegate any agreement to another party with written notice to The Client. This agreement shall be binding upon and inure to the benefit of the parties and their respective heirs, successors, attorneys, and permitted assigns.


17 — Drone Footage

Where drone footage is included in a selected package, its availability is subject to FAA regulations, local airspace restrictions, and venue-specific policies. GC holds all applicable certifications required for commercial drone operation and will make every reasonable effort to obtain necessary clearances in advance.

In the event that drone footage cannot be captured due to legal restrictions, adverse weather, venue prohibitions, or other factors beyond GC's control, no refund or fee reduction will be issued solely on the basis of the unavailability of drone footage. GC will notify The Client in advance if drone restrictions are anticipated at the venue.


18 — Waiver

No waiver of any default by any party to this agreement shall be implied from any omission by a party to take action on account of such default. If such default persists or is repeated, no express waiver shall affect any default other than the default specified in the express waiver, and only for the time and to the extent stated therein.


19 — Severability

If any provision of these Terms shall be declared invalid or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms, and all remaining provisions shall continue in full force and effect.


20 — Governing Law

These Terms shall be governed by and interpreted under the laws of the State of South Carolina, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or any individual service agreement shall be resolved in a court of competent jurisdiction in Charleston County, South Carolina.


21 — Entire Agreement & Counterparts

These Terms, together with any signed individual service agreement, constitute the entire understanding between the parties with respect to the subject matter hereof and supersede all prior written or oral agreements and understandings between the parties. No amendment or modification shall be effective unless executed in writing by both parties.

Any individual service agreement may be executed in counterparts, each of which shall constitute an original, and all of which together shall constitute one and the same agreement. A facsimile or electronic signature shall be treated as an original, and each party agrees to deliver to the other party an original executed agreement within seven (7) days of execution.


22 — Modifications to These Terms

GC reserves the right to update or modify these Terms of Service at any time. Updated Terms will be posted to our website at goldencelebrations.com with a revised effective date. Continued use of our services following such updates constitutes acceptance of the revised Terms. Signed individual service agreements are not retroactively affected by modifications to these general Terms.
